Terms of Use

These Terms of Use govern your use of nabes.org (the "Site"), operated by the National Association of Building & Engineering Services ("NABES", "we", "us"). By using the Site, creating an account, claiming a listing, sending a message through the Site or buying a membership or service, you agree to these terms. If you don't agree, please don't use the Site.

1. What the Site is

The Site is a directory of construction, engineering and trade contractors. Listings are built from public records, including SAM.gov, USAspending.gov and state and local procurement records, and from information firms give us. We are an independent association: we are not affiliated with or endorsed by SAM.gov, USAspending.gov, the U.S. Small Business Administration, or any federal, state or local government agency.

We try to keep listings accurate, but public records can be incomplete or out of date, and we don't guarantee that any listing is accurate, complete or current. A listing, badge or ranking is not an endorsement or a guarantee of a firm's qualifications, licensing, bonding or performance. You are responsible for your own due diligence before doing business with any firm.

2. Accounts and claiming a listing

You may claim or update a listing only if you are authorized to act for that business. When you create an account, you agree to give accurate information and keep it current. We confirm ownership using the business email domain on file, or by reviewing your claim manually, and we may ask for more evidence. We may decline, suspend or remove an account or a claim at our discretion, including when we can't confirm that you work for the business. You are responsible for activity under your account; tell us right away at support@nabes.org if you think someone else has used it.

3. Information you provide

You keep ownership of the information you add to a listing, such as capabilities, specialties, service area, descriptions, photos and videos. You give us a non-exclusive, royalty-free, worldwide license to host, display, reproduce and adapt it to operate and promote the Site. You confirm that you have the right to provide it and that it is accurate and lawful and doesn't infringe anyone's rights. We may edit, decline or remove content that we believe is inaccurate, misleading, unlawful or inappropriate.

4. Contacting firms

Messages sent through "Contact this firm" are reviewed before we pass them on, and we may decline to forward any message, for example spam, solicitations unrelated to the firm's work, or abusive content. Don't use the Site to send unsolicited advertising or to harvest contact information. We don't publish firms' email addresses.

5. Paid memberships

Premium and Preferred memberships are monthly subscriptions billed through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method each month until you cancel. Memberships renew automatically. You can cancel at any time from your account (Your membership) or by contacting us; cancellation takes effect at the end of the current billing period, and you keep the membership's benefits until then. Except where the law requires otherwise, payments are non-refundable and we don't give credits for partial months. If you move between plans, the difference is prorated: an upgrade is charged for the rest of the current period, and a downgrade is credited to your next invoice. We may change prices or membership benefits with at least 30 days' notice before your next renewal. If a payment fails, your listing may return to a standard listing.

Membership improves your listing's placement and presentation in the directory. It does not guarantee leads, contracts, awards or any business outcome.

6. Federal Registration Service

For a one-time fee, we help a business complete its registration in SAM.gov and obtain a Unique Entity ID (UEI). Registering in SAM.gov is free; our fee covers our time and help, and you can always register yourself directly at SAM.gov. We are not a government agency and can't control SAM.gov's review or timing. The result depends on the information you give us and on SAM.gov's own process, and we don't guarantee that a registration will be approved by a particular date or that it will lead to any contract. You are responsible for the accuracy of the information submitted for your business. Except where the law requires otherwise, the fee is non-refundable once we have started work.

7. Member badges

Premium and Preferred members in good standing may display the member badge on their own websites and materials, linked to their listing. The badge may not be altered, used by anyone else, or used to suggest an endorsement beyond membership. The right to use it ends when the membership ends, and we may revoke it if it's misused. The National Association of Building & Engineering Services name, seal and badges are our marks; you may not use them except as these terms allow.

8. Acceptable use

You agree not to:

  • scrape, crawl, copy or bulk-download the directory or its data, or use bots or automated tools to access the Site, except search engines following our robots.txt;
  • bypass or interfere with our security, rate limits or bot checks;
  • impersonate a person or business, or claim a listing you aren't authorized to manage;
  • use the Site for anything unlawful, fraudulent or harassing, or to send spam;
  • upload malware or anything that could harm the Site or its users.

9. Third-party services

The Site relies on third-party services, including Stripe for payments, Cloudflare for bot protection and Google for analytics and video. Your use of those services is also subject to their terms. Links to other websites are provided for convenience; we aren't responsible for their content.

10. Disclaimers

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We don't guarantee that the Site will be uninterrupted or error-free.

11. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, NABES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, CONTRACTS OR DATA, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 IF YOU PAID NOTHING.

12. Indemnity

You agree to indemnify and hold harmless NABES from claims, losses and expenses, including reasonable attorneys' fees, arising from information you provide, your use of the Site, or your violation of these terms or of anyone's rights.

13. Removal and termination

You can ask us to remove a listing at nabes.org/remove. We may suspend or end your access to the Site, or remove a listing, at any time if we believe these terms have been violated. Sections that by their nature should survive termination, including 3, 6, 10, 11, 12 and 14, will survive.

14. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute relating to the Site or these terms will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.

15. Changes to these terms

We may update these terms from time to time. We'll post the new version here with its effective date, and for material changes we'll give reasonable notice, such as by email to account holders. Continuing to use the Site after changes take effect means you accept them.
